5 YEAR LIMITED WARRANTY



North River Hospitality warrants the surface pile of the carpet to which this label is attached against excessive wear for indoor residential use. If, within five (5) years from date of purchase under normal wear, the surface pile abrasively wears more than ten percent (10%), North River Hospitality will compensate you for actual replacement costs of the worn area of the carpet at its expense. (The percentage of wear is based on weight of pile fiber loss as determined through an independent inspection by North River Hospitality.) Abrasive wear means fiber loss from normal wear, not from crushing or flattening of the carpet pile, or from staining, soiling, fading or any other changes in the carpet appearance. Matting and crushing or any other change in appearance retention does not constitute abrasive wear and are excluded from this warranty. Carpet installed outdoors, on stairs or in areas subject to other than ordinary shoe traffic is excluded from the coverage of this warranty. This warranty does not cover tears, burns, pulls, pilling, cuts, pills, odor or damage caused by improper installation, inadequate cushion, or improper cleaning/chemical agents or methods, or pressure from furniture, wheels or athletic equipment. In addition, the use of a vacuum cleaner with a beater bar, rotating brushes, or stiff bristles around the powerhead on any North River Hospitality’s carpets will void the warranty.

This warranty is extended to the original purchaser of the carpet and is not transferable. Carpet requires routine maintenance, and should be properly maintained according to North River Hospitality’s care instructions. The warranty applies to first quality carpets and is not applicable to carpet sold as seconds.

North River Hospitality reserves the right to correct any claimed carpet area prior to the carpet being removed, replaced, or any settlement being offered. If North River Hospitality cannot repair the carpet, North River Hospitality will replace the affected area of your carpet. If the carpet is not available, North River Hospitality will provide carpet of comparable quality, color and value. Any costs incurred in association with new carpet padding, moving furniture or equipment will be your responsibility. If North River Hospitality determines a valid claim, North River Hospitality will arrange a credit equal to the cost of the carpet. The credit will be issued to your retailer as a percentage of the replacement cost of new carpet of the same or comparable quality for the affected area.

Incidental and consequential damages are not the responsibility of North River Hospitality and, to the extent permitted by law, are hereby excluded both for property and to the extent not unconscionable, for personal injury damage. (Some states do not allow exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.)

This warranty is in lieu of all other express warranties which now or hereafter might arise with respect to this product. ANY AND ALL IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE SHALL HAVE NO GREATER DURATION THAN THE PERIOD FOR THE EXPRESS WRITTEN WARRANTY APPLICABLE TO THIS PRODUCT SHOWN ABOVE. (Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.)
